FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

April 25, 2015

TO:
Honorable Joe Deshotel, Chair, House Committee on Land & Resource Management

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB1472 by Workman (Relating to the enforcement of requirements for the issuance of local permits by regulatory agencies of political subdivisions.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to allow the Office of the Attorney General to bring legal action related to certain issuances of permits by local political subdivisions and make the local political subdivision liable for damages and attorney fees.  The bill would take effect September 1, 2015.

The Office of the Attorney General indicated the costs associated with implementation of the bill could be absorbed with existing resources.

Local Government Impact

The bill may have a significant fiscal impact on political subdivisions found liable for actual damages and reasonable attorney's fees; however, fiscal impact will vary depending on the number of cases and cannot be determined.
