May 1, 2015

TO:
Honorable John T. Smithee, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:

IN RE:
HB1520 by Thompson, Senfronia (Relating to the assignment to a trial court of a judge or justice who was defeated in a primary or general election.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code regarding an objection to an assigned judge who was defeated in the last election for which he or she was a candidate. The bill would clarify that these judges may not sit in either a criminal or civil case if either party objects. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact
