HB1751 by Simpson (Relating to the execution or enforcement of federal laws that violate the Bill of Rights of the Texas Constitution.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would provide that the legislature, by two-thirds vote of all members, could find a federal law in violation of the Texas Constitution. A state agency or political subdivision, or an officer or employee would be prohibited from executing or enforcing any law, provision, or penalty after such a finding. Not enforcing or executing a federal law found in violation of the Texas Constitution could result in a loss of certain federal funds, but it is unknown whether the legislature would choose to do so in the future and which federal law would be found in violation.

No significant fiscal implication to units of local government is anticipated.
