No significant fiscal implication to the State is anticipated.
The bill would amend Chapter 431 of the Health and Safety Code to require the Department of State Health Services (DSHS) and the Department of Agriculture (TDA) to take certain actions before entering into an agreement to implement or enforce a provision of the Federal Food, Drug, and Cosmetic Act. These actions would include publishing the proposed agreement in the Texas Register, allowing 90 days for public comment, consulting with the presiding officers of certain legislative committees, and publishing a final notice containing certain information in the Texas Register. DSHS indicates that this process would impact their ability to secure future agreements because it would be unable to meet agreement negotiation deadlines. This analysis assumes that future agreements will be continued because it is unknown if the federal government would accept the additional time DSHS indicates it would require to undertake this process. TDA indicates that the provisions of the bill would not affect their future agreements.
