No significant fiscal implication to the State is anticipated.

The bill would require a person or entity proposing to install a telephone or telegraph facility in the right of way of a state highway or county road to first give notice of installation to the Texas Department of Transportation (TxDOT) or the applicable county commissioners court. On receipt of the notice, the department or commissioners court, as applicable, may designate the location in the right of way where the person may install the facility. The bill would allow TxDOT or a county commissioners court to require a telephone or telegraph company to relocate a facility of the corporation, at the corporation's expense, to allow for changes or other improvements to a roadway or right-of-way. The bill would require TxDOT or the county to notify the company not later than the 30th day before the relocation is required by identifying the facility to be relocated and indicate the location on the new right of way where the new facility may be placed.

Based on the information provided by TxDOT, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within the agency's existing resources.
