No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code to limit civil liability arising from an employee wellness program. The bill would prohibit a civil action against an employer for establishing or requiring participation in an employee wellness program, unless the program discriminated against an employee based on factors such as gender, age, or income; or the cause of action was based on intentional or reckless conduct. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
