No significant fiscal implication to the State is anticipated.
The bill would amend the Family Code to extend the group of individuals who have standing to file suit affecting the parent-child relationship to include persons related to the child within the third degree of consanguinity. The bill would also shorten the time from 90 days to 30 for such a person to file suit requesting managing conservatorship or adoption of a child after the parent-child relationship is terminated in a suit filed by the Department of Family and Protective Services and would add a new requirement that the person filing such a suit show that his or her failure to become involved in a suit filed by the Department of Family and Protective Services was not due to the person's indifference or lack of diligence. Based on the analysis of the Office of Court Administration and the Department of Family and Protective Services, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
