No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to require rather than authorize the repayment of money spent by the Texas Department of Transportation (TxDOT) for participation in or contributions to the costs of a toll facility or turnpike project of a public entity, regional tollway authority, regional mobility authority, or other toll project entity. The provisions of the bill would apply to a loan, grant, or other contribution made by TxDOT or the Texas Transportation Commission on or after the effective date of the bill.  The bill would take effect on September 1, 2015.

TxDOT is currently authorized to require the repayment of money contributed to participate in the cost of a toll or turnpike project of a local toll project entity. Any repayment would be deposited to the credit of the fund from which the contribution was made. It is assumed the provisions of the bill would not result in a significant fiscal impact to the state.

Local Government Impact

A local toll project entity would incur costs for the repayment of any contribution of funds made by TxDOT for the costs of a local toll or turnpike project on or after the effective date of the bill. The costs to a local toll project entity would depend on the amount of funds contributed by TxDOT and the terms required by TxDOT for the repayment of the contribution to the costs of the project.
