No fiscal implication to the State is anticipated.
The bill would amend the Education Code to include "private or independent institutions of higher education" in certain definitions. The bill would create a misdemeanor offense, punishable by a fine of not more than $200, for an individual who violates provisions of the subchapter. Under the provisions of the bill, a governing body of a private or independent institution of higher education would be permitted to authorize representatives to deny an individual from entering the property.
The bill would repeal Section 51.202(b), Education Code.
The Office of Court Administration reported no significant fiscal impact to the state court system is anticipated.
Local Government Impact
There could be cost associated with the increase in the number of filings for certain offenses due to the expansion of the definition of "institution of higher education"; however these costs could be offset by the revenue from fines associated with the offenses.
No significant fiscal implication to units of local government is anticipated.
