No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code relating to procedures of an area proposed to be annexed to incorporate as a new general-law municipality. The bill would require a petition to be submitted no later than the 30th day after the municipality initiates annexation proceedings requesting the release of all or part of the area to be annexed and authorization to incorporate as a new general-law municipality. If the governing body of a municipality finds the petition to be valid, the municipality would release the area from the annexation proceedings and authorize the incorporation. Within 90 days of the release from annexation, the area must begin procedures for municipal incorporation. If the area is not incorporated within the first anniversary of the date the municipality released the area, the municipality may proceed with the annexation and the area may not present another petition until the fifth anniversary of the date of the initial petition.
