No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to require municipalities, who have adopted certain ordinances, to apply the ordinance uniformly to subsequent development of land use in the municipality's boundaries. Under the provisions of the bill, an individual with the authority to develop land would be permitted to request a municipality for a waiver to develop land that is located within the minimum distance area. If the municipality would accept and grant the waiver, the municipality would be required to file a notice in the real property records of the county. The bill provides requirements of the notice to be filed.
