No fiscal implication to the State is anticipated.

The bill would amend the Natural Resources Code to require a municipality that established a maximum proximity allowance for mineral exploration and development to apply the allowance uniformly to the development of identified markers within its boundaries. Under the provisions of the bill, a property owner or lessee would be permitted to petition a municipality for a waiver to utilize property within the area created by the proximity allowance. If the petition is granted, the waiver must be recorded in the county records.
