LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

April 19, 2015

TO:
Honorable John T. Smithee, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB2998 by Rodriguez, Justin (Relating to adoption of the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill proposes adoption of the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act through an amendment of Chapter 1253 (Interstate Guardianships) of the Estates Code and addition of Chapter 1254. The uniform act, as it indicates, only addresses issues for guardianships and protective proceedings for adults. The bill proposes to amend various sections of Chapter 1253 of the Estates Code in order to separately address minors. The uniform act establishes procedures to govern communications and cooperation between courts of this state and those of other states when guardianship issues cross those boundaries. The uniform act  provides a jurisdictional scheme based around the concepts of "home state" and "significant-connection state." The uniform act establishes procedures to govern transfer of proceedings from one state to another.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
