No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to specify the establishment of programs under Chapter 399, Local Government Code is a governmental function for all purposes. The bill would permit a representative of a local government to take actions under the chapter instead of a local governmental official. The bill would permit a program application fee paid by the property owner to be expressed as a set amount, a percentage of the amount or in any other manner. The bill would amend the requirements of proposed qualified project to include a verification. The bill would prohibit a lien from being contested under certain conditions. The bill would establish which entities a local government may contract with in an interlocal contract. The bill specifies that the members or employees of certain parties are not personally liable as a result of exercising any rights or responsibilities under Chapter 399, Local Government Code.
