The bill would amend the Education Code relating to rights to appeal rate and damage schedule determinations by the Board of Regents governing certain easements or other interests in land of The University of Texas (UT) System. The bill would allow an individual to appeal a rate or damage schedule determination to a district court for a de novo review within 30 days of receiving the Board of Regents final determination.
Based on information provided by UT System, each appeal initiated under the provisions of the bill would result in additional costs to the Permanent University Fund from the related legal defense costs. This analysis assumes any additional costs would not be significant.
Based on information provided by the Office of Court Administration, any additional costs associated with implementing the provisions of the bill could be absorbed within existing agency resources.
