HB3316 by Miller, Doug (Relating to the time for recording a durable power of attorney for certain real property transactions.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Estates Code to add that real property transactions must be recorded in the office of the county clerk of the county in which the property is located within 30 days after the date the instrument is filed for recording and would be voidable by any person if the durable power of attorney was not filed with the county clerk within 10 days after the date the real property transaction was filed. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
