IN RE:
HB3388 by Faircloth (Relating to increasing the fee on conviction paid by a defendant for a peace officer committing or releasing the defendant.), As Introduced
No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to increase the fee for either a defendant's commitment to jail, or their release from jail, from $5 to $90. This fee is collected by local governments and is not remitted to the state. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
Local Government Impact
According to the Office of Court Administration, assuming a 40% collection rate, there would be a $32,395,336 increase in revenue to local governments.
