Honorable Byron Cook, Chair, House Committee on State Affairs
FROM:
Ursula Parks, Director, Legislative Budget Board
IN RE:
HB3428 by Parker (Relating to the temporary continuation of utility service for real property of a decedent.), As Introduced
No significant fiscal implication to the State is anticipated.
The bill would amend the Estates Code to authorize the temporary continuation of utility service for real property of a decedent with costs for the continued service being a liability of the decedent's estate. The bill would allow the utility to require a copy of the death certificate to validate continuation of service, but would also require late fees or collection fees to be suspended during this time. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
Local Government Impact
No significant fiscal implication to units of local government is anticipated.
