The bill would amend the Local Government Code to permit certain emergency medical services personnel to appeal the withdrawal of the individual's authority to provide medical care and the termination of employment by a municipality to the State Office of Administrative Hearings. The bill would require a municipality to adopt procedures for referring the appeals.
Based on information provided by the State Office of Administrative Hearings (SOAH), this analysis assumes that SOAH would be reimbursed for costs associated with the bill through interlocal contracts with the affected municipalities. As such, it is further assumed that all duties and responsibilities necessary to implement the provisions of the bill could be accomplished utilizing existing staff and resources.
Local Government Impact
SOAH estimated total yearly costs of $38,525 to hear an estimated 25 cases each year under the provisions of the bill. This analysis assumes applicable municipalities would repay these costs through interlocal contracts established with SOAH.
The costs to a municipality would depend on the number of cases appealed through SOAH as set forth by the provisions of the bill.
