No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to prescribe certain design and construction provisions for the Texas Department of Transportation (TxDOT) in developing the Interstate Highway 635 East project from United States Highway 75 to Interstate Highway 30 in Dallas County.  The bill would prohibit the Transportation Commission from exercising other statutory authority to designate toll lanes, high occupancy vehicle lanes, or other exclusive revenue generating lanes on the project.
 
TxDOT reports that the agency is currently evaluating multiple construction scenarios for the Interstate 635 East project with design and construction costs ranging from $1.2 billion to $3.3 billion and each including managed lane components. Based on the information provided by TxDOT, the bill would prescribe specific design and construction elements for the project, including some elements not currently under consideration, and would prohibit the inclusion of managed lanes or other revenue-generating elements that could be considered in the overall financing of the project. Therefore, the costs to implement the provisions of the bill cannot be determined at this time. For the purposes of this analysis, it is assumed any costs or duties associated with developing the project in the manner prescribed by the bill would be accommodated within the agency's existing highway planning and construction funds.
