No significant fiscal implication to the State is anticipated.

The bill would amend the Estates Code to define a supported decision-making agreement (SDMA). The bill would authorize an adult with a disability to voluntarily enter into a SDMA with a supporter. The bill outlines the scope and the terms of the SDMA. The SDMA would extend until terminated by either party, the terms of the SDMA, or if the Department of Family and Protective Services (DFPS) finds that the adult with disability has been abused, neglected, or exploited by the supporter or if the supporter is found criminally liable for abuse, neglect, or exploitation conduct. The bill requires a person who believes an adult with a disability is being abused, neglected, or exploited by a supporter, to report the alleged abuse, neglect, or exploitation to DFPS.

The Department of Family and Protective Services does not anticipate any significant fiscal impact as a result of complying with the provisions of the bill.
