HB3641 by Smithee (Relating to payment of attorney's fees in an action brought under Chapter 37 of the Texas Civil Practice and Remedies Code.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code, regarding declaratory judgments, to limit an award of attorney's fees to $250,000 associated with a suit brought under Chapter 37 against the state government. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
