HB3743 by Spitzer (Relating to increasing the punishment for an offense involving the operation of a motor vehicle while intoxicated in which the actor causes bodily injury to another.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code to enhance the punishment for the offense of driving while intoxicated in certain circumstances. Under the provisions of the bill, this offense would be enhanced to a state jail felony if the person caused bodily injury to certain emergency personnel. This analysis assumes the provisions of the bill would not result in a significant impact on state correctional agencies.




Local Government Impact

A Class A misdemeanor is punishable by a fine of not more than $4,000, confinement in jail for a term not to exceed one year, or both. Costs associated with enforcement, prosecution, and confinement could likely be absorbed with existing resources. Revenue from fines imposed and collected is not anticipated to have a significant fiscal impact.
