LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

April 7, 2015

TO:
Honorable Tracy O. King, Chair, House Committee on Agriculture & Livestock

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB3944 by King, Tracy O. (Relating to judicial review of final orders arising out of nutritional programs administrated by the Texas Department of Agriculture.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Agriculture Code, regarding the various nutritional programs administered by the Texas Department of Agriculture (TDA).  The bill would provide that a decision of the TDA's administrative review official or of the State Office of Administrative Hearings (SOAH) in certain child and adult nutrition cases is a final administrative determination of TDA and would not be subject to judicial review, in alignment with federal guidelines. Both TDA and SOAH indicate that provisions of the bill may be reasonably absorbed within each agency's existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
