FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

May 7, 2015

TO:
Honorable Abel Herrero, Chair, House Committee on Criminal Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB3985 by Dukes (relating to the prosecution and punishment of the use of benzodiazepines or gamma butyrolactone to facilitate the commission of the offense of aggravated sexual assault and the addition of gamma butyrolactone to Penalty Group 1 of the Texas Controlled Substances Act for purposes of criminal prosecution; amending provisions subject to a criminal penalty.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code as it relates to the use of certain controlled substances to facilitate the commission of the offense of aggravated sexual assault. Under the provisions of the bill the definition of aggravated sexual assault would be expanded to include certain substances. The bill would also expand the list of Penalty Group 1 substances. This analysis assumes implementing the provisions of the bill would not result in a significant impact on state correctional agencies.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
