No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to permit counties to issue search warrants that lack a municipal court of record with both a courtroom located in that county and a judge of a municipal court of record who is an attorney licensed by the state. The county would be permitted to allow a county court judge who is an attorney licensed by the state, a statutory county court judge, or any magistrate to issue a search warrant. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
