HB4105 by Bell (Relating to the funding, issuing, and litigation of certain marriage licenses.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Section 2.001, Family Code, to prohibit state or local funds from being used for licensing a same-sex marriage; prohibit state or local government employees from recognizing, granting, or enforcing a same-sex marriage license; and prohibit state or local funds being used to enforce an order requiring the issuance or recognition of a same-sex marriage license.

The bill would amend Section 1118.022, Local Government Code, to require any county that collects a fee for issuing a marriage license to each month remit the total amount collected to the Comptroller of Public Accounts. The Comptroller of Public Accounts would deposit a portion of those fees as directed by current law and return to the county the amount that remains for all marriages that are not same-sex marriages. Any fees that remain would be deposited to General Revenue.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
