LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

March 20, 2015

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB418 by Whitmire (Relating to requests by the State Commission on Judicial Conduct for certain records held by court reporters.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to provide that, upon request of the State Judicial Conduct Commission (SCJC), a court reporter shall provide to the commission at no cost a backup audio recording of a court proceeding if one has been made.  It would also provide that a court reporter who fails to do so is considered to have committed a violation of his or her that could result in disciplinary action such as revoking or suspending the reporter's certification.  To the extent the bill would provide additional resources to the SCJC for investigations or disciplinary proceedings, no significant fiscal implication to the court system is anticipated.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
