SB638 by Nichols (Relating to the transfer of certain state property from the Texas Department of Transportation to the Shepherd Independent School District; requiring the payment of certain transaction fees.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would require the Texas Department of Transportation (TxDOT), not later than September 30, 2015, to transfer certain real property to the Shepherd Independent School District (Shepherd ISD). The bill would require Shepherd ISD to pay TxDOT an amount to reimburse TxDOT's actual costs to acquire the property.  Should Shepherd ISD use the property for any purpose other than a purpose that would benefit the public interest of the state, the bill would require Shepherd ISD to pay TxDOT an amount equal to the fair market value for the property less the amount paid to reimburse TxDOT's actual acquisition cost. Any funds transferred to TxDOT for that reason would be deposited to the credit of the State Highway Fund and used in the TxDOT district in which the property is located. The bill would require Shepherd ISD to pay any transaction fees associated with the transfer of property.
 
Based on the information and analysis provided by TxDOT, it is assumed the bill would not result in a significant impact to the State Highway Fund and any costs or duties associated with implementing the provisions of the bill could be absorbed within the agency's existing resources.

Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
