No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code to remove the net worth of a defendant from the list of evidence that must be considered when determining the amount of exemplary damages in a case and add that evidence of a party's financial condition or net worth are not relevant for purposes of supporting a claim for or the amount of exemplary damages. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
