LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

May 21, 2015

TO:
Honorable Abel Herrero, Chair, House Committee on Criminal Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB1086 by Campbell (relating to a parent ’s right to view the body of a deceased child before an autopsy is performed.), Committee Report 2nd House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure, regarding a parent's right to view the body of a child and depending on where the death occurred. The bill describes circumstances in which such viewings must be supervised by a physician, nurse, a justice of the peace, or a medical examiner. The bill would add provisions relating to that a parent of a child whose death occurs at a hospital or other institution is entitled to view the body, if practicable, before it is examined by a justice of the peace (JP) or medical examiner.  The Office of Court Administration indicates that to the extent the bill would amend court procedures, no fiscal implication to the court system is anticipated.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
