SB1457 by Nichols (Relating to bad faith claims of patent infringement; providing a civil penalty; creating a criminal offense.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Business and Commerce Code and the Penal Code to authorize the Office of the Attorney General to bring legal action against a person who has made certain bad faith claims of patent infringement.  The bill would take effect September 1, 2015.

The Office of the Attorney General estimates there would be a cost associated with implementing the bill provision.  It is assumed these costs could be absorbed within existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
