FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

April 28, 2015

TO:
Honorable Joan Huffman, Chair, Senate Committee on State Affairs

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB1600 by Kolkhorst (Relating to a limit on the award of attorney’s fees in certain proceedings brought against the state or an agency of the state.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code, relating to attorney's fees in a declaratory judgment action against the state or a state agency.  The bill would cap attorney's fees at $250,000.  The Office of Court Administration indicates that bill provisions are not anticipated to have a significant fiscal implication to the court system.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
