No significant fiscal implication to the State is anticipated.
The bill would amend the Government Code to specify that any municipal charter provision, ordinance, rule or regulation that conflicts with any provision of state law is null and void. The bill provides criteria of a municipal ordinance that conflicts with state law. The bill would permit the Attorney General to bring an action to enforce the provisions of the bill. The bill would prohibit a municipal charter provision, ordinance, rule or regulation from banning the provision or sale of a single-use bag or require a payment of fee for a single-use bag.

There could be a fiscal impact to municipalities depending on if the entity has such provisions, ordinances, rules or regulations in place and the number of actions brought forth by the Attorney General.
According to the Texas Municipal League, the fiscal implications of the bill cannot be determined; however costs associated with the bill could be significant.
