LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

April 7, 2015

TO:
Honorable Robert Nichols, Chair, Senate Committee on Transportation

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SJR17 by Perry (Proposing a constitutional amendment relating to private road work by certain counties.), As Introduced

No fiscal implication to the State is anticipated, other than the cost of publication.

The cost to the state for publication of the resolution is $118,681.

The bill would amend Article III of the Texas Constitution to authorize counties with a population of 7,500 or less to construct and maintain private roads if it imposes a reasonable charge for the work.

Local Government Impact

A county that chose to construct and maintain private roads would incur costs that may be all or partially offset by imposing a charge for the work; however, the amounts would vary depending on the number of road projects and the costs incurred and recovered. It is assumed that a county would exercise the authority only if sufficient resources were available or it would not result in a negative fiscal impact.
