LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

84TH LEGISLATIVE REGULAR SESSION

April 20, 2015

TO:
Honorable Myra Crownover, Chair, House Committee on Public Health

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB2267 by Davis, Sarah (Relating to the requirement to obtain a license to practice as an anesthesiologist assistant; providing an administrative penalty; authorizing fees. ), Committee Report 1st House, Substituted

The provisions of the bill addressing felony sanctions are the subject of this analysis. The bill would amend the Occupations Code to create a third degree felony for engaging in certain behaviors without holding an anesthesiologist assistant license. Under the provisions of the bill, these behaviors would become an offense on September 1, 2016.

A third degree felony is punishable by confinement in prison for a term from 2 to 10 years and an optional fine not to exceed $10,000.

Creating an offense is expected to increase correctional supervision and/or incarceration populations and thereby increase demands on county and/or state correctional resources. This analysis assumes the number of offenders convicted under this statute would not result in a significant impact on state correctional agencies, programs, or workloads.
