The provisions of the bill addressing felony sanctions are the subject of this analysis. The bill would amend the Penal Code to enhance the punishment for the offense of improper photography or visual recording if the victim was younger than 18 years of age from a state jail felony to a third degree felony.

Enhancing the punishment for any felony offense is expected to result in increased demand on the correctional resources of the state due to longer terms of felony community supervision or incarceration. In fiscal year 2014, 123 people were arrested, 19 were placed under felony community supervision, and 14 were admitted into state correctional institutions for the offense of improper photography or visual recording. Statewide data do not exist to indicate which of these offenses involved victims under the age of 18. However, this analysis assumes the bill's provisions would not result in a significant impact on state correctional populations, programs, or workloads.
