The provisions of the bill addressing felony sanctions are the subject of this analysis. The bill would amend the Business and Commerce Code related to prohibited practices around unauthorized recordings. The bill would expand the types of devices on which improperly labeled recordings could be made.

Expanding the list of behaviors for which a penalty is applied for any criminal offense is expected to result in increased demands upon the correctional resources of the state due to additional persons placed on community supervision or admitted to state correctional institutions. In fiscal year 2014, 67 people were arrested, 27 were placed under felony community supervision, and 15 were admitted into state correctional institutions for the offense of improperly labeled recordings. However, this analysis assumes the bill's provisions would not result in a significant impact on state correctional populations, programs, or workloads.
