SB1582 by Taylor, Van (Relating to the scheduling of controlled substances and the designation and emergency scheduling of certain substances as hazardous controlled substances; creating criminal offenses.), As Engrossed

The bill would amend the Health and Safety Code to permit certain Schedule I controlled substances to be defined as hazardous controlled substances. The bill would create the offenses of possession and manufacture or delivery of hazardous controlled substances, both of which would be punishable at various misdemeanor and felony levels, depending on substance amount. The designation of a substance as a hazardous controlled substance would not apply to any substances currently classified in the Penalty Groups included in the Health and Safety Code.


Expanding the types of substances for which possession is a criminal offense is expected to result in increased demands upon the correctional resources of the state due to additional persons placed under felony community supervision or admitted into state correctional institutions. This analysis assumes the provisions of the bill would not significantly impact state correctional populations, programs, or workloads.
