CRIMINAL JUSTICE IMPACT STATEMENT

84TH LEGISLATIVE REGULAR SESSION

May 30, 2015

TO:
Honorable Dan Patrick, Lieutenant Governor, Senate
Honorable Joe Straus, Speaker of the House, House of Representatives

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB1630 by Whitmire (Relating to the commitment of juveniles in post-adjudication secure correctional facilities operated by the Texas Juvenile Justice Department and by local probation departments.), Conference Committee Report

The provisions of the bill addressing felony sanctions for juvenile offenders are the subject of this analysis. The bill would amend various codes as they relate to the commitment of juveniles in post-adjudication secure correctional facilities operated by the Texas Juvenile Justice Department (TJJD). The bill would require the TJJD to develop a regionalization plan that includes sufficient mechanisms to divert 30 juveniles from TJJD commitment beginning September 1, 2015, and 150 juveniles from TJJD commitment beginning September 1, 2016.

Assuming sentencing patterns and policies not addressed in the bill remain constant, the probable impact on juvenile correctional populations of implementing the provisions of the bill requiring TJJD to divert a certain number of juveniles during each of the first five years following enactment is estimated as follows:

Fiscal Year Decrease in Demand for TJJD State Residential Capacity Decrease in Demand for Juvenile Parole Supervision Increase in Demand for Juvenile Felony Probation Supervision
2016 (30) 0 30
2017 (150) (10) 150
2018 (150) (62) 150
2019 (150) (108) 150
2020 (150) (108) 150
