Amend SB 3 (senate committee printing) in SECTION 2 of the bill, in added Section 250.009, Local Government Code, by adding the following appropriately designated subsection to that section and redesignating existing subsections accordingly:
( ) At the sole expense of the state, the attorney general shall defend a political subdivision, including a public school district, or an open-enrollment charter school against an action challenging this section under the Texas Constitution, the United States Constitution, or federal law. The state is solely liable for any damages, costs, or attorney's fees awarded to a plaintiff in such an action.
