Amend SB 3 (senate committee printing), in added Section 250.009, Local Government Code, by adding the following appropriately lettered subsection and relettering subsequent subsections accordingly:
( ) This section does not apply to a public school district or open-enrollment charter school that:
(1) is located primarily in a county that has a population of more than 1.5 million in which more than 75 percent of the population lives in a single municipality; and
(2) adopted on or before December 1, 2017, a policy or other measure that would allow a person to:
(A) access or use a restroom, shower, changing facility, or similar accommodation of the district or school that corresponds to the person's gender identity; or
(B) participate in athletic activities of the district or school in a manner that corresponds to the person's gender identity.
