Amend CSSB 6 (house committee report) by striking page 3, line 17, through page 4, line 1, and substituting the following:
Sec. 43.0116. AUTHORITY OF MUNICIPALITY TO ANNEX CERTAIN AREAS BY AGREEMENT. (a) This section applies only to an area:
(1) subject to an agreement for provision of services in lieu of annexation under Section 43.0563; or
(2) subject to a development agreement under Section 212.172, including an agreement described by Section 43.035 for an area qualified for agricultural or wildlife management use or as timber land.
(b) Notwithstanding any other law, a tier 2 home-rule municipality may annex all or part of an area described by Subsection (a) under the procedures established under an applicable agreement and applicable to a tier 1 municipality.
