A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to an optional fee in lieu of the dedication of parkland as |
|
|
a condition of approval by a municipality of land development or |
|
|
use. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Z, Chapter 212, Local Government |
|
|
Code, is amended by adding Section 212.905 to read as follows: |
|
|
Sec. 212.905. OPTIONAL FEE IN LIEU OF PARKLAND DEDICATION. |
|
|
A municipality that requires a dedication of parkland as a |
|
|
condition of approving an application for the development of or the |
|
|
use of real property must allow the applicant to pay an optional fee |
|
|
to the municipality in lieu of the dedication. |
|
|
SECTION 2. Section 212.905, Local Government Code, as added |
|
|
by this Act, applies only to an application for the development or |
|
|
use of land submitted to a municipality for approval on or after the |
|
|
effective date of this Act. |
|
|
SECTION 3. This Act takes effect December 1, 2017. |
