A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of a political subdivision to adopt or |
|
enforce a requirement that a builder or contractor obtain a license |
|
or other similar certification from the political subdivision. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. The heading to Chapter 250, Local Government |
|
Code, is amended to read as follows: |
|
CHAPTER 250. MISCELLANEOUS REGULATORY AUTHORITY OF MORE THAN ONE |
|
TYPE OF LOCAL GOVERNMENT [MUNICIPALITIES AND COUNTIES] |
|
SECTION 2. Chapter 250, Local Government Code, is amended |
|
by adding Section 250.009 to read as follows: |
|
Sec. 250.009. LIMITATION ON AUTHORITY TO REGULATE CERTAIN |
|
BUILDERS OR CONTRACTORS. A political subdivision may not adopt or |
|
enforce an ordinance, order, or other measure that requires a |
|
builder or contractor to obtain an occupational license or other |
|
form of certification from the political subdivision as a condition |
|
of obtaining a building permit or other authorization to construct |
|
or remodel a commercial structure. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect December 1, 2017. |
