LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATURE 1st CALLED SESSION - 2017

August 2, 2017

TO:
Honorable Sarah Davis, Chair, House Committee on General Investigating & Ethics

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB15 by Davis, Sarah (Relating to lobbying by certain former officers of state government; creating a criminal offense.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Government Code prohibiting a former legislature or statewide officeholder from engaging in activities that require registration under Chapter 305 of the Government Code for the first anniversary of the first date the person ceases to be a member of the legislature or statewide officeholder. A person who violates the provisions of the bill commits a Class B misdemeanor.

The bill would take effect January 8, 2019.

Local Government Impact

A Class B misdemeanor is punishable by a fine of not more than $2,000, confinement in jail for a term not to exceed 180 days, or both. Costs associated with enforcement, prosecution and confinement could likely be absorbed within existing resources. Revenue gain from fines imposed and collected is not anticipated to have a significant fiscal implication.
