LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATURE 1st CALLED SESSION - 2017

August 12, 2017

TO:
Honorable Charles Schwertner, Chair, Senate Committee on Health & Human Services

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB215 by Murphy (Relating to reporting and certification requirements by certain physicians regarding certain abortions.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend to statute to require certain abortion-related certifications be submitted to the Health and Human Services Commission (HHSC) rather than to the Department of State Health Services. HHSC would also now be required to prescribe the format of these certifications. The bill would require physicians to certify in writing the fetal abnormality identified for certain abortions. The bill would require physicians, who perform an abortion on a woman younger than 18 years old, to report certain information in her medical record as well as to HHSC. HHSC would not be permitted to publicly release the recorded information, except for certain instances. The bill would take effect immediately upon a two-thirds vote from all members of each house or, if such a vote is not received, on the 91st day after the last day of the legislative session.

Based on an analysis of the bill, it can be implemented within existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
