No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure as it relates to procedures in capital felony cases. Under the provisions of the bill, a death sentence could not be imposed on a defendant whose liability for a capital felony offense was based solely on the capital felony occurring in furtherance of a conspiracy to commit another felony offense in which the defendant was a co-conspirator.
This analysis assumes implementing the provisions of the bill would not result in a significant fiscal impact on the Office of Court Administration and would not result in a significant impact on state correctional agencies.
The bill would take effect December 1, 2017 and would apply only to criminal proceedings that commenced on or after the effective date of the Act.
Local Government Impact
No significant fiscal implication to units of local government is anticipated.
