No significant fiscal implication to the State is anticipated.

The bill would establish a commission to study intellectual and developmental disability determinations in capital cases in which the state seeks the death penalty. The bill would require the commission to be composed of two members appointed by the Governor, two members appointed by the Lieutenant Governor, two members appointed by the Speaker of the House of Representatives, two members appointed by the presiding judge of the Texas Court of Criminal Appeals, one member appointed by the Chief Justice of the Supreme Court of Texas, the chair of the House Committee on Criminal Jurisprudence, and the chair of the Senate Committee on Criminal Justice, as required by the bill.

The bill would not allow a member of the commission to be eligible for compensation or reimbursement of expenses for commission service. The bill would require the appointing officers to provide the commission with necessary support to enable the commission to perform its duties. The bill would require the commission to provide a report of its findings and recommendations no later than January 1, 2019. The bill would abolish the commission on January 31, 2019.

This analysis assumes duties and responsibilities associated with implementing the provisions of the bill could be accomplished bill within existing resources.  Minimal costs are anticipated for both the Senate and House of Representatives in implementing the provisions of the bill.
