LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATURE 1st CALLED SESSION - 2017

August 8, 2017

TO:
Honorable Roland Gutierrez, Chair, House Committee on Defense & Veterans' Affairs

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB362 by Gutierrez (Relating to granting certain local governments general zoning authority around federal military installations; creating a criminal offense.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code relating to a local government's zoning authority around federal military instillations. The bill would create an offense punishable by a fine if a person violates provisions of the bill.

The bill would take effect December 1, 2017.

Local Government Impact

According to Bexar County the bill would have a small to moderate fiscal impact if the county entered into an interlocal agreement with the City of San Antonio for administration and enforcement of such zoning agreements. If the county did not enter into an interlocal agreement the enforcement of the bill would create a large fiscal impact as staff would have to be hired.

According to the Texas Municipal League, no significant fiscal impact from the bill is anticipated.
